Richie Muir
Richie is an experienced lawyer specialising in property law (and in particular property development work) across multiple states. He is the legal director at Lawlab (www.lawlab.com.au) and leads a national team of lawyers and conveyancers that has managed over 45,000 transactions throughout Australia in the last few years. Richie has also recently joined the board of PIPA (Property Investment Professionals of Australia) so is well established to provide the right advice even on the most complex of matters.

What is a Deed Of Partition I hear you ask….?

Simply put…it's a way to structure a deal IF one of the property owners wants to retain ownership of one or more lots after the project is completed and could SAVE YOU paying thousands of additional Stamp Duty.

BUT….you MUST understand it's uses, and more importantly it's limitations.

Not obtaining THE RIGHT legal advice (specific to your own circumstances) at the start of your projects from someone well versed on the topic can be a VERY costly mistake.

Wendy Macdonald
Wendy's a Property Investor & Developer aka 'wheeler & dealer' and has been doing deals in New Zealand and Australia for over 40 years. She worked for a Developer full time in Australia for 5 of those years, managing the design and construction phase of their land subdivisions. Wendy loves the 'hustle' that Property and Property Development provides, and has even written a book to help women build wealth through property development.
'Real Deal' Presentation
Our Real Deal comes from Wendy Macdonald and was a 1 into 2 lot Subdivision with MANY many twists along the way!

This one was a DOOZY….and with so many learnings, Wendy has gone as far as changing the way she structures ALL of her deals for the future.

Located in Mooloolaba on 750m2 zoned Medium Density, this site was initially approved for a 1 into 3 lot Subdivision, and whilst a great design outcome for the smaller lots was initially achieved, Wendy quickly realized that unless she could successfully build a quality product on such a small block, AND that someone would actually buy the product being created, then it would be a 'NO DEAL'!

Compounded further by the slope of the land, Wendy's Builder #1 thought the blocks were unworkable, so she quickly pivoted her strategy and decided to sell the deal on with the approved DA.

She successfully sold the site with a $100k non refundable deposit paid upfront, BUT…as the pointy end of the deal arrived…'aka' Settlement Day….the Buyers were UNABLE to settle, and subsequently lodged legal proceedings to stop their deposit being refunded and put a caveat over the house…Oh dear!

Long story short…this deal does have a hidden silver lining, and don't you worry, Wendy will be sharing all the 'gory' details on the day!

So come along to hear how Wendy's 1 into 3 lot Subdivision, whilst initially caught up in 'litigation land' for 12 months, ended with a 1 into 2 lot Subdivision, and is a good case study on being able to retire off one site - if it's the RIGHT outcome!
