After being a construction lawyer for 23 years, Mike Krsticevic decided to take a career break and build a factory at the request of and for a friend. Mike has a Civil Engineering degree and several years of hands on building experience (with his family) prior to starting a law degree, but had never built something this big before or been solely responsible for every aspect of the build with full responsibility and authority. Since completing the factory development as a contracted project manager, he has opened his own legal practice focused on construction law (predominantly helping clients with drafting, reviewing and negotiating contracts, managing payment disputes through the NSW Security of Payment Act and conducting training for builders and subcontractors).

You’ve heard Rob say the best way to get into a low or no money down deal is to create a win-win situation with the property owner…

Well, how about this project for a doozy!!!

Mike’s friend owns and operates a joinery business and was searching for a larger premises to move his business to, ultimately finding this site to construct a 3,250m2 factory with 45 car spaces. A huge step up from his existing 650m2 shed!!!

As the Project Manager on this exciting project, Mike was responsible for every aspect of the build with full responsibility and authority… including every engineering detail, every tender and contract, all compliance obligations, dealing with private certifier and Council, etc.  YIKES!

Being on site every day meant the complex build went relatively smoothly… HOWEVER he also had to manage all challenges that arose!

- Massive cost overruns (anticipated pre-commencement estimate of cost was $5.8m; final actual cost was $8m).
- $100k cost overrun for rock excavation in basement carpark that did not show up in geotech surveys.
- Council required substation to be installed (meaning every new factory in the surrounding area was required to install a substation, which is not technically necessary but was Council's requirement). Extra $120k.
- Challenging design obligations with respect to hydraulics and civil (stormwater) design due to Council DA conditions (but managed to resolve it with new technology - siphonics).
- Expensive design. In future, might not have done basement carpark (although it did add substantial value).
- Challenges closing out the build to achieve OC, particularly remaining fire compliance obligations, but resolved in the end.
- Odd mistake in scoping work in contracts resulted in additional unplanned costs.
