Probably not! Let’s face it… there’s no contract that can do all three. In fact, most of the industry’s standard form contracts are heavily weighted in favour of the builder and cause developers to bear the brunt of the key risks (even though most of these risks are within the builder’s control!).

If you don’t get this right, you may face major delays (for which YOU are obligated to pay), cost overruns which eat into your profit, and disputes which drag on and prevent you from capitalising on your investment!

Mahsa Solomons
Mahsa Solomons is a registered architect whose main focus is high-end residential design. Her property development journey started in 2013 when she began to do cosmetic and structural renovations and flip them for a profit. Opportunity called in late 2015, when Mahsa and her husband (architect also and all-round construction guru) came across the Belrose property. When that development came to a close, she decided to set up her own architecture and interiors practice for a few years. She and her husband are currently looking for their next townhouse development project.

Have you ever been looking for a project, only to find something that was SO MUCH better than what you were originally looking for?

Mahsa and her husband were looking for a structural renovation deal, when they drove past the sale sign for this site.  What they didn't realise at the time was that they had stumbled across a UNICORN!

However, to create the end product that was the ‘highest and best use’ of the site meant that they had to be a MARKET MAKER! Because there were no direct comparable sales, this meant that their Commercial Finance valuation came in below their required target! Yikes!!!

And that wasn’t the end of Mahsa’s predicaments:

- The vendor passed away prior to settlement
- Post tender award, the builder struggled to obtain Home Owners Warranty insurance due to the new icare eligibility rules
- Builder made excessive attempts for variations and extension of time claims
- Challenging sales process due to over-55 market
- Increased design and construction liability due to Seniors Living designation
