Massive Qld Property Law Overhaul

The new Property Law Act 2023 (set to commence on 1st August 2025) is the biggest overhaul of property law in Queensland in 50 years and includes the introduction of a brand new mandatory seller disclosure scheme.

These changes in the new Property Law Act 2023 along with other recent legislative changes, will have a SIGNIFICANT impact on the way developers contract for both sales and purchases.

Changes in legislation create a tricky operating environment where timing can mean a substantial difference in your outcome, where things are not what they have always been, and where you can be caught out if you do not know the new legislative environment you’re operating in, e.g.

- if a developer's contract contains unfair contract terms they may be liable for a penalty of up to $50 Million (or more), or
- a developer may not be entitled to terminate an off-the-plan sale contract under a sunset clause in a contract - even where the contract was entered into before the recent amendments to the Land Sales Act 1984!

Henry Ledingham's background is founded on a Bachelor of Construction Management and working within the Commercial Construction Industry for 10 years. Henry has worked for several Tier 1 & 2 Builders and cut his teeth in the world of Project Management across NSW, ACT & QLD. Having delivered over $350 million of commercial projects during his Project Management career, a personal interest in Property Investment sparked a desire to explore Property Development and combined with Henry's Construction/Project Management background the first 6 Lot Subdivision was embarked upon in 2018. After successfully completing his first land subdivision and realising he wanted to "get serious" about development he joined the PDN network and enrolled in the 2019 PDF program with the plan to quit the "employee" lifestyle at the end of the PDF course. In 2020 Affirmo was founded and full-time land development started and has continued ever since!
Henry currently has a 12 Lot Land Subdivision in Lawnton & 15 Lot Subdivision in Bli Bli in the pipeline.
'Real Deal' Presentation
21 Lot Land Subdivision

1.5ha, General Residential - Suburban Neighbourhood Zone, Caboolture, City of Moreton Bay Council, Queensland

Imagine diving into your fifth property development project and taking on a two-stage, 21 Lot Land Subdivision. Sounds intense, right?

Well, that's exactly what Henry Ledingham did - despite initially losing control of the site to another developer! Yikes!

Stage One involved a 1 into 2 Subdivision separating off the current owners’ home and creating a vacant lot to "purchase". Then…

Stage Two – a 21 Lot Land Subdivision of the vacant lot.

Despite Henrys’ years of prior experience in the construction industry, it wasn’t all smooth sailing… Just a few of the issues he needed to tackle were:

- a stubborn council refusing to condition the stage 1 physical works into stage 2 (resulting in 2 x construction mobilisations)
- Unitywater wanting "approved" drawings redesigned
- receiving 70% of Cabooltures annual rainfall in the first 3 months of the year (causing Civil works delays)
- clashes with external services requiring a major Stormwater redesign

During the onsite road construction, geotechnical testing and test pits revealed there was double the usual amount of topsoil! This needed to be stripped off – and then adding back that amount of fill! PLUS extra material to stabilise the road base. AND the site is very flat so had to be built up to get enough grade for the stormwater to drain off…

The $$$’s just kept adding up! As a welcome repreive to the many project challenges being thrown at him, Henry was able to gain an additional lot in his approval due to an ingenious stormwater management design approach.

This is a tale of resilience, innovation, and sheer determination as Henry battled wet weather delays galore and clashes with external services requiring major redesigns!
