Deal Killers in Development Contracts! Tuckfields Conveyancing (Samantha Phillips)

How many property developments get into trouble before construction has even started?

For many developers, the biggest risks aren't the obvious ones. They're buried in contracts, finance clauses, due diligence, subdivision applications, easements, settlement dates and legal details that seem minor at the time but can end up costing months of delays or tens of thousands of dollars.

The reality is that most developments don't fail because of one major mistake. They fail because of a series of small issues that could have been identified and managed from the very beginning.

At this month's Property Developer Network Meetup, Samantha Phillips from Tuckfields Conveyancing will share eight real-life deal killers she regularly sees in property development transactions. Through practical case studies, she'll explain how developers can avoid costly setbacks before they happen.

In this presentation, you'll discover:

•        Why the purchase contract is the foundation of every successful development.
•        The contract clauses that are commonly overlooked and how they can put your project at risk.
•        How to structure finance and timing clauses to better suit your development.
•        Why thorough due diligence can save you from expensive surprises later.
•        How incorrect subdivision applications can create "death by delay."
•        What you need to understand about easements, encumbrances and by-laws before you buy.
•        The risks hidden in off-the-plan contracts and how to build in the right safety nets.
•        How to avoid settlement surprises caused by missing documentation, delayed approvals and title issues.

If you're a mum-and-dad property developer who wants to reduce risk, protect your profit and avoid mistakes that could have been prevented from day one, this is a presentation you won't want to miss.

Join us and learn how to identify the hidden deal killers before they derail your next development.
Antony Carpena began his property journey in 2012 with the purchase of a two-bedroom unit in Sydney. After completing a cosmetic renovation, he lived in the property for a year before retaining it as a long-term investment. The equity created from that property enabled him to acquire two additional off-the-plan townhouse investments in Queensland, which he later sold in 2023 and 2024 due to servicing pressures and limited capital growth. Prior to selling his Sydney property, Antony completed a second renovation and worked with the owner’s corporation to improve the presentation of the complex, helping to achieve a sale price that significantly exceeded the property's previous rate of growth. The equity released from the sale provided the foundation for his current Adelaide development project and principal place of residence. Having first studied property investing in 2016, Antony later expanded his knowledge through specialised property development education, including the Property Developer Network course and other mentoring programs. These experiences inspired his transition from passive property investing into active property development. Antony is currently delivering a one-into-three subdivision through a joint venture with experienced Adelaide developers, using a house-and-land exit strategy. With that project well underway, he is actively sourcing his next development opportunity as he continues to grow his experience and portfolio.

What if your next development could create long-term wealth not just a quick profit?

The truth is...

The most successful developments aren't just about buying the right site. They're about structuring the deal correctly from day one.

With the right strategy, you can secure planning approvals before settlement, minimise unnecessary costs, and create opportunities that simply aren't available to developers who follow the traditional path.

At our next Property Developer Network Meetup, Antony Carpena will reveal how a strategic delayed settlement, creative implementation of legal documentation, and careful planning allowed him to get a head start on approvals, avoid additional stamp duty, and secure his own homesite at below market value.

Antony will share:
·        How a delayed settlement gave him a valuable head start
·        Why the right JV agreement and supporting documentation saved significant stamp duty
·        How selling one dwelling early helped create long-term value
·        The planning and subdivision delays that impacted the project mid-way
·        The lessons learned navigating council and bank approvals

This is a genuine, behind-the-scenes case study that demonstrates how smart planning, the right professional team, and a well-structured deal can create opportunities that many developers never realise are possible.

If you're looking to structure your next development more strategically, reduce unnecessary costs, and learn from a developer who's been through the process firsthand, this is one Real Deal presentation you won't want to miss.
